Biography of Anne Bonny, Irish Pirate and Privateer

Anne Bonny (1700–1782, exact dates uncertain) was an Irish pirate and privateer who fought under the command of Calico Jack Rackham between 1718 and 1720. Together with fellow female pirate Mary Read, she was one of Rackhams more formidable pirates, fighting, cursing, and drinking with the best of them. She was captured along with the rest of Rackhams crew in 1720 and sentenced to death, although her sentence was commuted because she was pregnant. She has been the inspiration for countless stories, books, movies, songs, and other works. Johnson (most, but not all, historians believe that Johnson was actually Daniel Defoe, author of Robinson Crusoe) provides some details of Bonnys early life  but did not list his sources and his information has proven impossible to verify. According to Johnson, Bonny was born near Cork, Ireland probably sometime around 1700, the result of an affair between a married English lawyer and his maid. The unnamed lawyer was eventually forced to bring Anne and her mother to America to escape the gossip. Anne’s father set up in Charleston, first as a lawyer and then as a merchant. Young Anne was spirited and tough: Johnson reports that she once badly beat up a young man who â€Å"would have lain with her, against her will.† Her father had done quite well in his businesses and it was expected that Anne would marry well. Instead, at about age 16, she married a penniless sailor named James Bonny, and her father disinherited her and cast them out. The young couple set out for New Providence, where Annes husband made a meager living turning in pirates for bounties. Sometime in 1718 or 1719, she met pirate Calico Jack Rackham (sometimes spelled Rackam) who had recently wrested command of a pirate vessel from the ruthless Captain Charles Vane. Anne became pregnant and went to Cuba to have the child: once she had given birth, she returned to a life of piracy with Rackham. A Life of Piracy Anne proved to be an excellent pirate. She dressed like a man, while she fought, drank, and swore like one too. Captured sailors reported that after their vessels were taken by the pirates, it was the two women—Bonny and Mary Read, the latter who had joined the crew by then—who urged their crewmates on to greater acts of bloodshed and violence. Some of these sailors testified against her at her trial. According to legend, Bonny (dressed as a man) felt a strong attraction to Mary Read (who was also dressed as a man) and revealed herself as a woman in hopes of seducing Read. Read then confessed that she was a woman, too. The reality may have been that Bonny and Read most likely met in Nassau as they were preparing to ship out with Rackham. They were very close, perhaps even lovers. They would wear womens clothes on board  but change into mens clothes when a fight was in store. Capture and Trial By October of 1720, Rackham, Bonny, Read, and their crew were infamous in the Caribbean and in desperation, Governor Woodes Rogers authorized privateers to hunt and capture them and other pirates for bounties. A heavily armed sloop belonging to Captain Jonathan Barnet caught up to Rackhams ship when the pirates had been drinking and after a small exchange of cannon and small arms fire, they surrendered. When capture was imminent, only Anne and Mary fought against Barnet’s men, swearing at their crewmates to come out from under the decks and fight. The trials of Rackham, Bonny, and Read caused a sensation. Rackham and the other male pirates were swiftly found guilty: he was hanged with four other men at Gallows Point in Port Royal on November 18, 1720. Reportedly, he was allowed to see Bonny before his execution and she said to him: Im sorry to see you here, but if you had fought like a man you need not have hanged like a dog. Bonny and Read were also found guilty on November 28 and sentenced to hang. At that point, they both declared that they were pregnant. The execution was postponed, and it was found to be true that the women were pregnant. Death Mary Read died in prison about five months later. What happened to Anne Bonny is uncertain. Like her early life, her later life is lost in shadow. Captain Johnson’s book first came out in 1724, so her trial was still fairly recent news while he was writing it, and he only says of her, â€Å"She was continued in prison, to the time of her lying in, and afterwards reprieved from Time to Time, but what is become of her since, we cannot tell; only this we know, that she was not executed.† So what happened to Anne Bonny? There are many versions of her fate and no truly decisive proof in favor of any one of them. Some say she reconciled with her wealthy father, moved back to Charleston, remarried and lived a respectable life into her 80s. Others say she remarried in Port Royal or Nassau and bore her new husband several children. Legacy Annes impact on the world has been primarily cultural. As a pirate, she did not have a large impact, because her pirating career only lasted a few months. Rackham was not an important pirate, mostly taking easy prey like fishing vessels and lightly armed traders. If not for Anne Bonny and Mary Read, he would be a footnote in pirate lore. But Anne has gained great historical stature in spite of her lack of distinction as a pirate. Her character has much to do with it: not only was she one of only a handful of female pirates in history, but she was one of the die-hards, who fought and cursed harder than most of her male colleagues. Today, historians of everything from feminism to cross-dressing scour the available histories for anything about her or Mary Read. No one knows how much of an influence Anne has had on young women since her days of piracy. At a time when women were kept indoors, barred from the freedom that men enjoyed, Anne went out on her own, left her father and husband, and lived as a pirate on the high seas off and on for two years. Her greatest legacy is probably the romantic example of a woman who seized freedom when the opportunity presented itself, even if her reality was probably not nearly as romantic as people think. His father bitterly opposed the idea, and warned his son that "if I did take this foolish step, God would not bless me - and I would have leisure hereafter to reflect upon having neglected his counsel, when there might be none to assist in my recovery." These words proved prophetic. The youthful Crusoe set out on his first voyage, with little knowledge about the perils of a sailor's life. In telling later about the tremendous storm in which his ship was caught, he remarked, "It was my advantage, in one respect, that I did not know what they meant by 'founder,' till I inquired." So ill and afraid was he during this first harrowing crisis, that he vowed never again to leave solid ground if he was blessed enough to escape drowning. But this voyage also met disaster: fierce hurricanes wrecked the ship, drowning everyone aboard except Robinson, who was finally tossed up on a desolate beach.A subsequent storm washed the ship's wreckage close to shore and Crusoe constructed a raft to haul most of its supplies to land, where he stored them in a makeshift tent. After a few days, he climbed a hill and discovered that he was on what he assumed to be an uninhabited island. In his wanderings he also caught a parrot, whom he taught to speak. Apply the law on terms in different contracts A standard form contract (sometimes referred to as an adhesion or boilerplate contract) is a contract between two parties, where the terms and conditions of the contract are set by one of the parties, and the other party has little or no ability to negotiate more favourable terms and is thus placed in a take it or leave it position. Examples of standard form contracts are insurance policies (where the insurer decides what it will and will not insure, and the language of the contract) and contracts with government agencies (where certain clauses must be included by law or regulation). These contracts have the potential to reduce transaction costs by eliminating the need to negotiate the many details of a contract for each instance a product is sold or a service is used. However, these contracts also have the ability to trick or abuse consumers because of the unequal bargaining power between the parties. For example, where a standard form contract is entered into between an ordinary consumer and the salesperson of a multinational corporation, the consumer typically is in no position to negotiate the standard terms. As example MetLife representative often does not have the authority to alter the terms, even if either side to the transaction were capable of understanding all the terms in the fine print. These contracts are typically drafted by corporate lawyers far away from where the underlying consumer and vendor transaction takes place. The danger of accepting unfair or unconscionable terms is greatest where these artful drafters of such contracts present consumers with attractive terms on the visible or â€Å"shopped† terms of most interest to consumers, such as price and quality, but then slip one-sided terms benefiting the seller into the less visible, fine print clauses least likely to be read or understood by consumers. For example a customer of MetLife can be assured for accident protection, but there are only a specific accident that the company may cover the client. In many cases, the consumer may not even see these contracts until the transaction has occurred. In some cases, the seller knows and takes advantage of the knowledge that consumers will not read or make decisions on these unfair terms.(Standard Form of Contracts, 2014). P2.3. Evaluate the effect of different terms in given contracts In the business scenario 4, terms stipulated in the contract are the payment for the research assistant ( £25000) and the working hours, witch in this case are â€Å"whatever hours are necessary to complete the assignments given to her†. Section 1 of Employment Rights Act 1996 that in fact requires the employer to state the amount of hours worked by the employee. Disciplinary procedures had to be insert in the terms of a contract, where, for example Miss Y had to receive a number of warnings that will be given to her before suspension or dismissal, for her behaviour of wearing trousers and not a dress, on the morning of 2nf June. Contrast liability in tort with contractual liability Tort liability arises out of a civil wrong, for example, people who do business, sole proprietor or in a partnership are liable for the torts committed by themselves and for torts committed in the course of the business by their agent and/or partners. However, one may avoid tort liability for the acts of business associates if they operate their business as a corporation or a limited liability company. Thus, the choice of entity is too perceived to have potential benefit if one is concerned about limiting one’s tort liability. Regardless of what type of business organization a person is liable for torts committed by himself, if for example he/ she is driving the company vehicle and are involved in an accident the other party is liable if he/she negligently operated the vehicle whether he/she operate as a corporation, partnership or sole proprietor. Contractual Liability, appears when a corporation or a limited liability company may protect one’s pe rsonal assets should the operator incur a significant contractual liability from the business operation. For example, a building contractor signs a contract to construct an office building for a business client and fails to meet the contractual deadline, the business client holds the contractor liable for consequential damages profits lost for the time the client is not able to occupy the new building. Particularly in the construction area, contractual  liability may exceed simply the contract price. So long as one does not personally guarantee the contract of the business entity, his or her personal assets, assets owned outside the corporation or LLC, are protected as the corporate operator should not be personally liable for the corporate debts, contracts and contractual liabilities. Often, however, people dealing with corporations demand that the principals of the corporation personally guarantee the contracts. (Business Law, 2014). P3.2. Explain the nature of liability in negligence Liability of negligence appears when a claimant is able to prove that: â€Å"the defendant owed him a legal duty of care; the defendant was in breach of their duty; and the claimant suffered injury or loss as a result of the breach†. (Riches, S. Allen, V. 2011:348). For example a producer of goods may be liable to a consumer for loss and damage caused by his defective product under the tort of negligence. A consumer must establish the manufacturer owed him a duty of care. In Donoghue v Stevenson (1932) case, House of Lords established the principles that a manufacturer was a duty of care to all persons who are likely to come into contact with his goods. The breach in duty occurs if the fallowing factors such as the like hood that the damage or injury will be incurred, the serious of any damage or injury, the cost and ease of taking precautions and the social need for the activity. (Balton v Stone (1951). In the final part the claimant has to prove that he suffered damage if t his damage was caused by a negligent misstatement as in the case of Hedley Byrne Co Ltd v Heller and Partners Ltd (1963), or it was consequent upon foreseeable physical injury or damage to property such in the case of Junior Brooks Ltd v Veitcho Co Ltd (1982). P3.3. Explain how a business can be vicariously liable Employers can be held vicariously liable for acts of negligence or omission on the part of their employees in the course of employment even if the employer did not authorise or was unaware of the acts in question. To mount a successful defence, an employer must demonstrate either that the employee was not negligent or that the employee was acting in an individual capacity unrelated to the business of the employer. In some circumstances employers may also be liable for the misdemeanours of their independent contractors or  workers employed by a third party, such as an agency. For example, this applies where the employer authorises the wrongful act or had overall responsibility that could not be delegated. For example an employee that works for a catering agency, who does wrong doing at one of the clients that the agency is sending him to work for, the agency can be responsible for. The main deciding factor as to which employer has the responsibility for a sub-contractor or agency worker is that of control. The employer who gives direction and instructions for the work to be conducted will usually be the one to bear responsibility for misdemeanours carried out during the course of that work. If more than one employer can be identified as having control over the work of the employee then the principle of dual vicarious liability may apply. This is a principle introduced by the decision of Lord Justice May in the recent case of Via systems (Tyneside) Limited v Thermal Transfer (Northern) Limited Others. The case involved compensation for a flood at a factory which had been caused by the sub-contractor of a sub-contractor. In his ruling, Lord Justice May decided that more than one employ er could be subject to a claim and that the amounts awarded should be split equal unless it could be clearly demonstrated that one party bore more of the responsibility than the other. This courageous decision overturned the principle established in Laugher v Pointer in 1826 that only one employer could be held vicariously liable. (Vicarious Liability, 2014). On the one hand, it can be argued therefore that the duty of care of the UK ship was broken, because the ship supposed to take more precautions on the duty of care and harm any neighbour. The defendant has break their duty of care  because the likelihood of an accident such as this could be foreseen. On the other hand, it can be argued that the defendant can claim â€Å"res ipsa loquitur†, witch mean that the facts spick for themselves, and it can be prove to court that the UK ship took enough safety precaution to avoid any accident, therefore the defendant would not be seen as negligent. The condition must be satisfied for res ipsa to come to play are in case of the event which caused the accident must have been the defendant’s control, witch in this case can be argued that it was, and the accident must be in such nature that it would not have occurred if proper care had been taken by the defendant, witch again could be argued that the ship took enough safety precaution. The damage that occur after this accident was that the claimant suffered damaged on his wharf, thereby he has to prove in court that this damages was made as a consequences of the UK ship actions in the harbour. In the case of Business Scenario 6, the negligence was made by Shell, because they had failed to provide protection goggles to Bell while he was working in spite of the fact that this was not a normal practice at the firm. Negligence was also made but the employee Bell, because firstly he supposed to protect himself especially because he had lost one eye, and he could have been more precaut. The breach of duty was made by Shell, because the job that Bell has implied vehicle maintenance, and while working with materials such as metals, the company should have provided protection for Bell under the Consumer Protection Act 1987. Bell, can therefore claim compensation for its employee negligence towards him, because he suffered injury while working at Shell Company. P4.2. Apply the elements of vicarious liability in given business situations Low states that an employer is liable for damage caused to another person by his employee, while the employee was caring out his work. The employer is liable even though he was not in any way at fault, and this rule even if seems to be unfair for the employer, it is based upon the law and policy. By doing this in clothing ads they lure the consumer into thinking that it is the clothes that are making them look that perfect, when actually, it's for the most part camera tricks and a lot of starvation. Advertisers often use fear tactics, or slippery slope to scare the women into thinking that their product is the only thing keeping them from being overweight. Most often these cases are found in weight loss pills and appetite suppressants that show before and after pictures of someone who has successfully used their product.Have you ever seen a model in an ad for beauty products or a clothing store that was not completely gorgeous? It makes pretty good sense doesn't it? Who would want to buy clothing worn by plain or even ugly people? I find myself falling into this superficial trap every time I look at the circulars in the Sunday paper. I want to look as perfect as they do, a nd sometimes think that by wearing their clothes, my looks will improve. However it does not take me long to realize how ridiculous I sound. Participants instructed to neutralize their facial expressions were less expressive than participants instructed to act naturally. With in the experiment, an aggression task was given to participants designed to measure their aggression. Participants were told they were going to play a trail game & to win the game they must push a key faster than online opponent.Prior to each trial the participants were asked to set the noise level (between 0-10, 0= no sound, 10= loudest sound), which would sound at the opponent when the participant would win. After each trail the opponent’s noise choice level was displayed on the screen as one level higher than what the participant set. As a result, partic ipants were thought to believe their opponent were more aggressive than they were, evoking aggressive behavior from the participant. Thus participants in the sleep deprived/ depletion group selected higher noise levels than non- sleep deprived/ non-depletion group.Accordingly, the data collected supported state of sleep does not affect a person self control or influence aggressive behavior. A Critical Analysis of "The Doctor Won't See You Now" Initially, James Gorman appears to be stating that physicians should not be ethically obligated to treat each and every "slob" that seeks treatment. Gorman confirms his argument with the first of many disenchanted views. Making a comparison that " old people who are on their way out anyway" (page 62) are responsible for rising health care costs. Gorman then becomes almost offensive when he suggests some AIDS patients deserve their predicament and others don't. At this point, the reader sees that Gorman is being very sarcastic and bitter towards physicians who mare share this view. In paragraph three, Gorman attempts to make an analogy between other professions and related obligations. In essence, the analogy equates the amount of money and personal taste one may have, with the level of care and/or attention one deserves. The analogy appears to be very inappropriate at first, however, this may be exactly what Gorman is trying to point out, making the reader more sympathetic to the thesis. Gorman begins to touch on a sound idea of preventative medicine in paragraph four, page 62, where he writes "... the medical profession is finally beginning to see that patients have a responsibility for their own health". The credibility of the previous statement is destroyed when Gorman goes on to make a false analogy, comparing doctors with small business, and suggests that their is no difference between the two fields. Gorman suggest that, like in small business, doctors should eliminate the "riffraff" in their establishments. Unfortunately, the definition of riffraff is never revealed. Gorman goes on further to suggest which diseases or ailments should not be treated without any reason except personal bias. Making a hasty generalization would usually destroy credibility on an issue, but used with the tone and thesis of this essay, it actually supports Gorman's point.
